Gildstep Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and [OPERATOR NAME] ("Gildstep," "we," "us," or "our"). They govern your use of the Gildstep mobile app, website, and related services (the "Service"). By checking the agreement box when you sign up (or when we ask you to review updated terms), or by using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Service.
1. What Gildstep is (and isn't)
Gildstep is a personal accountability tool. It helps you set goals, pick a daily "One Thing," check in, track streaks and progress, reflect weekly, and optionally share progress with a community.
Gildstep is not medical, psychological, financial, legal, fitness, or other professional advice, and it isn't a substitute for it. Mood ratings, reflections, streaks, and AI feedback are for your own motivation only. If you're struggling with your mental or physical health, contact a qualified professional. If you're in crisis or danger, contact your local emergency number right away.
Before starting any fitness, diet, or health-related goal, talk to a qualified professional. You're responsible for the goals you set and how you pursue them.
2. Eligibility
You must be at least 13 years old to use Gildstep, and at least the age of digital consent where you live (for example, 16 in some EU countries). If you're under the age of majority where you live, you may use Gildstep only with the involvement and permission of a parent or legal guardian, who agrees to these Terms on your behalf. You may not use Gildstep if you're barred from doing so under applicable law, or if we've previously banned your account.
3. Your account
- Give accurate information when you sign up, and keep your email address current. We use it for important account messages.
- Keep your password confidential. You're responsible for activity under your account. Tell us promptly at support@gildstep.com if you suspect unauthorized access.
- One person per account. Don't create accounts by automated means, impersonate anyone, or pick a name or username that's misleading, offensive, or infringes someone else's rights. We may reclaim or change usernames that violate these Terms.
- You can delete your account anytime in Profile → Settings → Data → Delete account. Deletion is permanent and can't be undone. Export your data first if you want a copy.
4. Your content
"Your Content" means everything you create or upload in Gildstep: goals, plans, check-ins, reflections, One Things, weekly reviews, your profile (name, username, photo, identity statement), and community posts.
- You own Your Content. We don't claim ownership of it.
- License to us. You grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, and transmit Your Content solely to operate, secure, and provide the Service to you, and, for content you make visible to others, to display it to them. This includes resizing photos and computing stats from your entries. The license ends when you delete the content or your account, except for copies in backups for a limited period (see our Privacy Policy) and content others have already copied.
- Your responsibility. You're responsible for Your Content. You confirm that you have the rights to what you upload and that posting it doesn't violate these Terms, the law, or anyone's rights.
- Public content. Posts you set to Everyone, and your public profile card, can be seen by other users. Photos are stored at links anyone with the link can open. Share only what you're comfortable making public.
5. Community rules
The Feed exists for sharing real progress and encouraging each other. When you post, cheer, or otherwise interact, you agree not to post or do anything that:
- Harasses, bullies, threatens, intimidates, or demeans anyone, or promotes violence or hatred based on race, ethnicity, national origin, religion, disability, sex, gender identity, sexual orientation, age, or any other protected characteristic.
- Is sexually explicit or pornographic, exploits or endangers minors in any way, or is excessively violent or graphic.
- Promotes or glorifies self-harm, suicide, or eating disorders, or encourages dangerous or illegal activity.
- Is false or misleading in a way that could cause harm, including medical misinformation.
- Contains someone else's personal or private information without their permission, or impersonates a person or organization.
- Infringes copyrights, trademarks, or other intellectual-property or privacy rights.
- Is spam, advertising, solicitation, or a scheme to manipulate cheers, streaks, levels, or milestones.
- Contains malware or links to malicious sites.
We have zero tolerance for objectionable content and abusive users. We may remove any content and suspend or terminate accounts that break these rules, with or without notice.
Reporting and blocking. Every post has a ⋯ button:
- Report post sends the post to us for review, with the reason you choose. The post disappears for you right away, and its author isn't told who reported it. A post reported by several different people is hidden from everyone automatically until we review it.
- Block hides all of that person's posts from you. They aren't notified. You can unblock people in Profile → Settings → Privacy → Blocked users.
You can also email support@gildstep.com. We review reports within 24 hours, remove content that breaks these rules, and remove users who post it.
We don't pre-screen all content and aren't responsible for content posted by others. Seeing other people's posts is at your own discretion.
6. Acceptable use of the Service
You agree not to:
- Access or try to access other users' private data, or anything you're not authorized to reach.
- Probe, scan, or test the Service's vulnerabilities, or bypass its security or access controls. Good-faith security research reported privately to support@gildstep.com is welcome.
- Interfere with or disrupt the Service, overload it, or use bots, scrapers, or other automated means to access it without our written permission.
- Reverse engineer, decompile, or copy the app, except where the law expressly allows it.
- Use the Service to break any law or to build a competing product from our content or design.
- Resell, sublicense, or commercially exploit the Service without our permission.
7. AI features
Some features ("Get AI feedback," "Check my goal," "Build my plan," the weekly AI coach, plan tune-ups, and the monthly report's reflection) use third-party artificial intelligence (currently Anthropic's Claude) to generate responses. When you use them:
- The goal and plan text, the One Thing, and (for the coach, tune-ups and monthly reflection) counts of your check-ins and time that the feature looks at are sent to our AI provider to produce the response, as described in our Privacy Policy.
- Limits. Free accounts get a small number of tries of AI feedback, the goal check and the plan builder; Premium accounts get a set number per day. The weekly coach, plan tune-ups and the monthly reflection are part of Premium, with a set number per goal each week or month. The tries and daily limits are shown in the app, may change, and are counted by your saved time zone. A request that fails, or that the AI declines, doesn't count.
- Suggestions change nothing until you choose them. A suggested plan, a coach's step, or a tune-up is saved only after you review and accept it, and a tune-up can be undone.
- If the feedback suggests a different wording for your One Thing, nothing changes unless you tap Use this.
- AI output may be inaccurate, incomplete, blunt, or unsuitable for your situation. It's automated, isn't reviewed by a person, and isn't professional advice. Use your own judgment. Don't rely on it for decisions about your health, safety, finances, or legal matters.
- Don't submit other people's personal information, or anything you're not comfortable sending to our AI provider.
- We may change, limit, or discontinue AI features at any time.
8. Streaks, XP, levels, and milestones
Streaks, streak freezes, XP, levels, milestones, and other in-app achievements are motivational features. They have no monetary value, can't be transferred, sold, or redeemed, and aren't property you own. We may adjust how they're calculated (for example, to fix errors or improve fairness), which can change the numbers shown. Account deletion permanently removes them.
9. Reminders
Reminders are local notifications scheduled on your device based on your settings. Delivery depends on your device, operating system, notification permissions, and settings such as Focus modes, so we can't guarantee that any reminder will be delivered or delivered on time. Don't rely on Gildstep for time-critical or safety-critical alerts.
10. Paid features
Gildstep's core features (goals, plans, check-ins, streaks, friends and trophies) are free. Gildstep Premium adds the weekly AI coach, plan tune-ups, monthly report reflections and deeper insights, more AI use (plan builder, goal check, daily feedback), room for more active goals, more streak freezes, and extra themes, badge styles and app icons. Premium isn't on sale yet; until it is, free accounts get a few tries of each AI feature.
- Plan limits. Free accounts can have up to 2 active goals at once and Premium up to 5. Paused, finished and archived goals don't count. Limits are shown in the app and may change.
- If Premium ends, nothing you made is deleted or locked. Goals above the free limit stay as they are. To add or resume one, you'll first pause, finish or archive another. Streak freezes you've already banked stay usable, and the app goes back to the default look.
When we offer Premium or other paid features:
- Prices, billing periods, renewal terms, and cancellation details will be shown before you buy.
- Purchases made through the Apple App Store or Google Play are processed by them under their terms, and refunds are handled under their policies.
- Additional terms will apply, and we'll present them when you buy.
11. Our intellectual property
The Service, including its software, design, text, graphics, logos, icons, and the "Gildstep" name, is owned by us or our licensors and protected by intellectual-property laws. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for your personal, non-commercial use. All rights not expressly granted are reserved.
If you send us feedback or suggestions, we may use them freely without any obligation to you.
12. Copyright complaints
If you believe content on Gildstep infringes your copyright, send a notice to support@gildstep.com that includes:
- Your contact information.
- The copyrighted work you believe was infringed.
- The content you believe infringes it, with enough detail for us to find it.
- A statement that you have a good-faith belief the use isn't authorized.
- A statement, under penalty of perjury, that your notice is accurate and that you're the owner or authorized to act for the owner.
- Your physical or electronic signature.
We'll remove infringing content where appropriate and terminate repeat infringers.
13. Changes, suspension, and termination
- Changes to the Service. We're continually improving Gildstep and may add, change, or remove features at any time. If we discontinue the Service entirely, we'll try to give you reasonable notice and a chance to export your data.
- Suspension or termination by us. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect users or the Service. Where appropriate, we'll tell you why and give you a chance to export your data, unless doing so would be unlawful or create risk.
- Termination by you. You can stop using the Service and delete your account at any time.
- What survives. Sections 4 (license ends as stated), 8, and 11 through 20 survive termination.
14. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. THIS INCLUDES IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DON'T WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE;
- STATS, STREAKS, OR AI OUTPUT WILL BE ACCURATE;
- REMINDERS WILL BE DELIVERED;
- YOUR DATA WILL NEVER BE LOST; OR
- USING GILDSTEP WILL HELP YOU REACH ANY PARTICULAR GOAL OR OUTCOME.
Keep your own copies of anything important; the in-app export is there for that.
Some jurisdictions don't allow certain warranty exclusions, so some of the above may not apply to you. Nothing in these Terms limits rights you have under consumer-protection laws that can't be waived.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW:
(a) GILDSTEP AND ITS OWNERS, EMPLOYEES, AND SUPPLIERS WON'T BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE, GOODWILL, OR OPPORTUNITY, ARISING OUT OF OR RELATED TO THE SERVICE OR THESE TERMS, EVEN IF WE'VE BEEN ADVISED OF THE POSSIBILITY; AND
(b) OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF (i) THE AMOUNT YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (ii) US $50.
These limits don't apply to liability that can't be limited by law, such as liability for death or personal injury caused by negligence, or for fraud. If you're a consumer in the EEA or UK, we're responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence. We aren't responsible for loss or damage that isn't foreseeable.
16. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Gildstep and its owners, employees, and suppliers from any claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your misuse of the Service, or your violation of these Terms or of anyone's rights.
17. Governing law and disputes
These Terms are governed by the laws of [GOVERNING STATE/COUNTRY], without regard to its conflict-of-laws rules. Before filing a claim, please contact us at support@gildstep.com and try to resolve the dispute informally for at least 30 days.
Any dispute that isn't resolved informally will be brought exclusively in the courts located in [VENUE], and you and we consent to their jurisdiction. Either party may still bring an individual claim in small-claims court if it qualifies.
If you're a consumer in the EEA or UK, you keep the protection of the mandatory laws of your country of residence and may bring proceedings in your local courts.
18. Apple App Store terms
If you downloaded Gildstep from Apple's App Store, you also agree to the following:
- These Terms are between you and us only, not Apple. We, not Apple, are solely responsible for the app and its content.
- Your license to use the app is limited to use on Apple-branded products you own or control, as permitted by the App Store's Usage Rules.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the extent permitted by law, Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for any product claims, consumer-protection or legal claims, and intellectual-property infringement claims relating to the app.
- You represent that you aren't located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you aren't on any U.S. government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
The same applies, with the necessary changes, to Google Play and other app stores, to the extent their terms require it.
19. General
- Entire agreement. These Terms and our Privacy Policy are the entire agreement between you and us about the Service.
- Changes to these Terms. We may update these Terms. If a change is material, we'll notify you in the app or by email at least 14 days before it takes effect, unless it's needed sooner for legal or security reasons. Continuing to use the Service after that means you accept the changes. If you don't agree, stop using the Service and delete your account.
- Severability. If any provision is found unenforceable, the rest remain in effect.
- No waiver. Not enforcing a provision isn't a waiver of it.
- Assignment. You may not transfer these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure. We're not liable for delays or failures caused by events beyond our reasonable control.
